These terms apply to everyone who signs in to the iFleet platform. They sit alongside the agreement between your organisation and us, which sets out prices, payment, refunds, service levels and how long the contract runs. Where the two differ, that agreement applies to your organisation.
1. About these terms
The platform is run by Island Communications Ltd, a company registered in Mauritius under business registration number C09018515, with its registered office at 13C, Volcy de la Faye St, Beau Bassin, Mauritius ("we", "us"). You can reach us at [email protected]. Customers in Zambia contract with our subsidiary, ICL Zambia Ltd.
"The platform" means the iFleet web portal and the iFleet, iCon and iTask mobile apps. It is for business use. By signing in, you accept these terms.
2. Your account
- Your organisation gives you access and decides what you can see and do. Your access ends when your organisation removes it, or when its agreement with us ends.
- Keep your password and sign-in codes to yourself and do not share your account. You are responsible for what is done with it.
- If you think someone else has used your account, tell your organisation's administrator straight away, or write to us at [email protected].
3. Using the platform properly
You must not:
- track, record or monitor anyone except as your organisation has lawfully decided and told the people concerned, including with the notices in vehicles and buildings that the law requires;
- use the platform to stalk anyone, or keep tracking a vehicle or device your organisation no longer has the right to track, for example after it has been sold;
- break the law, or anyone's privacy or other rights;
- try to get into accounts, workspaces or data you have not been given;
- probe, scan or test the platform's security, or work around its limits, without our written permission;
- copy, scrape, resell or reverse-engineer the platform, except as the law allows;
- upload malware, or content that is unlawful or that you have no right to share;
- overload the platform or interfere with other people's use of it.
4. Safety
- Never use the apps while driving. Stop somewhere safe first.
- Positions, readings and alerts depend on devices, satellites and mobile networks. They can be late, wrong or missing.
- The platform is not a crash-avoidance system and not an emergency service. The panic button and the platform's alarms do not replace calling the emergency services.
- Some features act on the real world, such as stopping a vehicle's engine from starting or switching building equipment on and off. Use them only as your organisation's procedures allow and when it is safe. The platform cannot see what is happening around a vehicle or a machine, and a command can be delayed or fail, so always check the result.
5. Scores, alerts and AI
Driver scores, alerts and answers produced by AI can be wrong. Check them before you rely on them, and do not base decisions about people, such as disciplinary action, on them alone. Your organisation decides whether AI features are switched on.
6. Your organisation's data
The information your organisation puts into the platform belongs to it. We use it only to provide the service, as our agreement with your organisation and our privacy policy describe. We do not sell it or use it to train AI models. When the agreement ends, your organisation can export its data before we delete it, as the agreement sets out.
7. Our platform
The platform, the apps and our brands belong to us or our licensors. While you have access, you may use them for your organisation's work. No other right passes to you. If you send us suggestions, we may use them without owing you anything.
8. The mobile apps
- Install the apps from the official app stores or from your organisation. A store's own terms also apply to apps you get from it.
- Keep the apps up to date: older versions may stop working.
- The apps ask for permissions such as camera, location and notifications. You can change these in your phone's settings, but some features then stop working.
9. Availability and changes
We improve the platform and may change or remove features. We work to keep it available, but cannot promise that it will always be uninterrupted or free of errors, and planned maintenance may interrupt it for short periods. Apart from what your organisation's agreement promises, and anything the law does not allow us to exclude, the platform is provided as it is and as available.
10. Suspending access
We may suspend an account or a workspace to protect the platform or other users, if these terms are broken, or if the law requires it. Where we can, we tell your organisation first.
11. Liability
Your organisation's agreement sets out our responsibilities to it, including any limit on our liability. As far as the law allows, we are not liable to individual users for indirect or consequential loss, or for loss caused by devices, networks or services we do not control. Nothing in these terms limits liability for fraud or gross negligence, or any other liability the law does not allow to be limited, and nothing takes away rights you have under the laws of Mauritius or Zambia that cannot be waived.
12. Privacy
How we handle personal data is explained in our privacy policy.
13. Law and disputes
If your organisation is based in Zambia, these terms are governed by the laws of Zambia, and the courts of Zambia decide any dispute about them. Otherwise they are governed by the laws of the Republic of Mauritius, and the courts of Mauritius decide. Either way, we will first try to settle a dispute by talking to you or your organisation.
14. Changes to these terms
We may update these terms. We post the new version on this page with its date. For significant changes, we tell your organisation at least 30 days before they take effect, and it can raise objections under its agreement. If you keep using the platform after a change takes effect, the new terms apply to you.
15. General
If a court finds part of these terms invalid, the rest still applies. If we do not enforce a term straight away, we can still enforce it later. We may send you notices in the platform or by email.
